1. Acceptance of Terms

By accessing or using the REPL8D mobile application ("App," "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and REPL8D ("we," "us," or "our"). By tapping "Continue" on the sign-in screen, you confirm that you have read, understood, and agree to these Terms and our [Privacy Policy](https://www.repl8d.com/privacy-policy).

2. Description of the Service

REPL8D is a culinary archive and recipe curation platform that allows users to:

  • Create and share personal recipe collections ("REPL8S")

  • Remix and riff on existing recipes posted by other curators

  • Follow and discover other curators and their culinary archives

  • Photograph and upload images of their dishes

3. Eligibility

You must be at least 13 years of age to use REPL8D. By using the App, you represent and warrant that you meet this age requirement.

If you are under 18, you represent that you have obtained parental or legal guardian consent to use the App and to agree to these Terms.

4. User Accounts

REPL8D uses Sign In With Apple as its sole authentication method. By signing in, you authorize us to create and maintain a profile associated with your Apple ID.

You are responsible for:

  • Choosing a curator handle that is appropriate, accurate, and does not impersonate any person or entity

  • All activity that occurs under your account

  • Keeping your Apple ID credentials secure

We reserve the right to suspend or terminate accounts that violate these Terms.

5. User-Generated Content

5.1 Your Content

"User Content" means any recipes, text, images, collection titles, bios, or other materials you submit, upload, or share through the App.

You retain ownership of all User Content you create. By posting User Content to REPL8D, you grant us a non-exclusive, worldwide, royalty-free license to store, display, distribute, and make available your content to other users of the App for the purpose of operating and improving the Service.

5.2 Remix ("REPL8") Content

REPL8D is built around culinary remixing. When you "REPL8" another user's recipe, you are creating a derivative work inspired by that recipe. By posting a recipe to REPL8D, you acknowledge and accept that other curators may use your recipe as the basis for their own REPL8S.

5.3 Content You Are Responsible For

You — not REPL8D — are solely responsible for your User Content and the consequences of sharing it. You represent and warrant that:

  • You own or have the necessary rights to the content you post

  • Your content does not violate any applicable law or the rights of any third party

  • Your content complies with these Terms

6. Prohibited Conduct

You agree not to use REPL8D to post, share, or transmit content that:

  • Is false, misleading, or deceptive

  • Is defamatory, harassing, abusive, threatening, or discriminatory

  • Contains graphic violence, sexually explicit material, or content harmful to minors

  • Infringes the intellectual property, privacy, or other rights of any third party

  • Violates any applicable local, state, national, or international law or regulation

  • Is spam, unsolicited commercial communications, or automated content

  • Impersonates any person, curator, or entity

We reserve the right to remove any content that violates these Terms without notice and to suspend or terminate accounts of repeat violators.

7. Reporting Inappropriate Content

REPL8D provides an in-app mechanism to report inappropriate content. If you encounter content that violates these Terms, tap "REPORT CONTENT" at the bottom of any recipe detail view. Reports are reviewed by our team.

8. Intellectual Property

8.1 Our Property

The REPL8D name, logo, design, and all original app content (excluding User Content) are the intellectual property of REPL8D and are protected by applicable copyright, trademark, and other IP laws. You may not copy, reproduce, or distribute any part of the App without our express written consent.

8.2 Feedback

If you submit feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback without restriction or compensation to you.

9. Privacy

Your use of REPL8D is subject to our [Privacy Policy](https://www.repl8d.com/privacy-policy), which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

In summary, REPL8D:

  • Does not sell your personal data to third parties

  • Does not track you across other apps or websites

  • Uses Sign In With Apple exclusively — we never store your Apple ID password

  • Stores recipe content and profile data in Apple CloudKit

10. Account Deletion

You may delete your account at any time from within the App by navigating to Edit Profile → Delete Account. Upon deletion:

  • Your profile, recipes, and collections will be permanently removed from REPL8D's servers

  • Deleted content cannot be recovered

  • Any REPL8S (remixes) created by other curators based on your recipes will remain, as they are independent works

11. Termination

We reserve the right to suspend or terminate your access to REPL8D at any time, with or without notice, for conduct that we determine:

  • Violates these Terms

  • Is harmful to other users, us, or third parties

  • Is otherwise objectionable

Upon termination, your right to use the App ceases immediately. Sections 5.1, 7, 8, 11, 12, 13, and 14 survive any termination of these Terms.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any recipe or content shared through the App.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, REPL8D SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY — ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED $100 USD.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Continued use of the App after changes become effective constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

Any disputes arising under these Terms shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction in those courts.
